By registering on MyChamp.ru
(hereinafter — the Site), you confirm that you have read, understood and
agree to comply with these Terms of Service (hereinafter — the Rules).
The administration (hereinafter — the Administration) of the MyChamp.ru service
(Cyrillic name: Мой Чемпионат)
reserves the right to amend and/or supplement these Rules at any time
without prior and/or subsequent notice.
1. User rights and obligations
1.1 The Site is available
for your personal use only. By using the Site, you acknowledge that
materials you upload or otherwise make available on or through the Site
may potentially infringe legally protected property and/or personal rights of
third parties, contain personal data including exclusive intellectual property
rights, and may contain information prohibited from distribution under
applicable local law.
1.2 These Rules prohibit the following on the Site:
1.2.1 Collecting or harvesting
email addresses or other contact information of Site users by automated
or other means for the purpose of sending unsolicited mail (spam) or other
unwanted information;
1.2.2 Using the Site
in any manner that could interfere with the normal operation of the Site
and its services;
1.2.3 Using automated scripts
(programs) to collect information and/or interact with the Site and
its services;
1.2.4 Uploading, publishing,
transmitting, or otherwise making publicly available (hereinafter — posting)
any content that contains threats, discredits or insults other users or third
parties, is vulgar, obscene, fraudulent, infringes personal or public interests,
promotes racial, religious, or ethnic hatred or hostility, or any other
information violating legally protected human and civil rights;
1.2.5 Posting
any commercial advertisements, commercial offers, promotional materials,
distributing spam, chain messages (messages requiring forwarding to one or more
users), pyramid scheme promotions or invitations to participate in them, or any
other intrusive information, except where such posting has been approved by the
Administration;
1.2.6 Posting on the
Site home addresses, phone numbers, email addresses, identity document
details, or other personal information of other users or any third parties
without their explicit consent;
1.2.7 Posting
any files that contain or may contain viruses or other malicious software;
1.2.8 Describing or promoting
criminal activity, or posting instructions or guides for committing
criminal acts;
1.2.9 Attempting in any way,
including by hacking, to gain access to another user's account without that
person's consent;
1.2.10 Posting
any content that infringes the exclusive intellectual property rights of users
or third parties;
1.2.11 Posting
any other content that, in the sole opinion of the Administration,
is undesirable, inconsistent with the purposes of the Site,
harms users' interests, or is otherwise undesirable for posting
on the Site.
1.2.12 Using the Site's services
to distribute information that, in the sole opinion of the Administration,
is undesirable, inconsistent with the purposes of the Site,
harms users' interests, or is otherwise undesirable for distribution via
the Site's services.
1.3 The Administration reserves the right, at its sole discretion, to edit
(moderate)
or delete any content you publish that violates the prohibitions set out in
clause 1.2 of the Rules (including private messages),
and to suspend, restrict, or terminate your access to all or any part of the
Site's sections or services at any time, for any reason or no reason,
with or without prior notice, without liability for any harm this may cause you.
1.4 The Administration
expressly reserves the right to delete your account and/or suspend, restrict,
or terminate your access to any Site service if the Administration
determines that, in its opinion, you pose a threat to the Site and/or
its users.
1.5 The Administration reserves the right to pre-moderate football
tournaments and football clubs registered on the Site, and may refuse
registration without explanation.
1.6
Users of the Site who publish contact details of football tournaments,
their administrators, football clubs and/or club captains agree that this
information will be visible to all users of the Site.
1.7
Users of the Site who publish contact details of club players agree
that this information will be visible only to other players of that club and
to no one else without their explicit consent.
1.8
Users of the Site who post a listing to find a new team agree that
the contact details they provide will be visible to all users of the Site.
1.9 The Administration undertakes not to send to users' email
addresses any information of an advertising or other nature not directly
related to the activities of the Site.
2. Liability for infringement of exclusive rights to Content posted on the Site
2.1 You are solely responsible
for any Content or other information you upload or otherwise make
publicly available (post) on or through the Site. You may not
upload, transmit, or publish Content on the Site if it was not
created by you personally or if you do not have the rights holder's permission
to post it;
2.2 You understand and agree
that the Administration may, but is not obliged to, review the Site
for prohibited Content and may remove or relocate (without notice) any
Content or users at its sole discretion, for any reason or no reason,
including without limitation the removal or relocation of Content that,
in the Administration's sole opinion, violates these Rules,
is or may be unlawful, or may violate rights, cause harm, or threaten the
safety of other users or third parties;
2.3 You are solely responsible
for preserving (backing up) Content that you post or store
on the Site;
2.4 By posting your Content
on the Site, you authorise the Administration to make copies of
your Content for the purpose of organising and facilitating the
publication and storage of user Content on the Site;
2.5 By posting your Content
in any part of the Site, you automatically grant the Administration
a royalty-free non-exclusive licence to use it by copying, publicly performing,
reproducing, adapting, translating, and distributing it for the purposes of
the Site or in connection with them, including for its promotion. For
these purposes the Administration may create derivative works or
incorporate your Content as components of relevant compilations and
take other actions serving these purposes;
2.6 If you decide to delete
your Content, the rights mentioned in clause 2.5 of the Rules
will be automatically revoked; however, you should be aware that the
Administration may retain archive copies of user Content;
2.7 The Site may
contain links to third-party websites as well as articles, photographs,
illustrations, graphics, music, sounds, video, information, applications,
software, and other Content belonging to or originating from third
parties (third-party Content);
2.8 Such third parties and
their Content are not verified by the Administration for
compliance with any requirements (accuracy, completeness, good faith, etc.).
The Administration is not responsible for any information posted on
third-party websites accessed through the Site or through third-party
Content, including any opinions or statements expressed on those
websites or in their Content;
2.9 Links or guides to
downloading files and/or installing third-party software posted on the
Site do not imply endorsement or approval of such actions by the
Administration;
2.10 A link to any website,
product, service, or information of a commercial or non-commercial nature
posted on the Site does not constitute endorsement or recommendation
of such products or services by the Administration;
2.11 If you decide to leave the
Site and visit third-party websites or use or install third-party
software, you do so at your own risk, and from that point these Rules
no longer apply. In your subsequent dealings you should be guided by the
applicable rules and policies, including the business practices of those
whose Content you use.
3. Liability of Site users and the Administration
3.1 As the Site
is an open-access, non-pre-moderated information resource, the
Administration accepts no responsibility for any user or third-party
Content posted on or through the Site;
3.2 You are solely responsible
for the Content you post on the Site, any information
you communicate to other users, and your interactions with other users;
3.3 User-posted Content
is not subject to mandatory review by the Administration before
publication (pre-moderation) and does not necessarily reflect the
Administration's opinion on any matter. The Administration
gives no warranties, express or implied, in relation to any Content,
its accuracy, currency, or reliability;
3.4 The Administration
is not responsible for the conduct of any users or third parties using or
viewing the Site, whether online or offline;
3.5 The Site or its
services may from time to time be partially or fully unavailable due to
maintenance or other technical work or for any other technical reason.
The Administration has the right to carry out necessary maintenance
or other work at any time at its sole discretion, with or without prior
notice to users;
3.6 The Administration
is not responsible for any errors, omissions, interruptions, deletions,
defects, delays in processing or transmitting data, communication line
failures, theft, destruction, or unauthorised access to user materials
posted on the Site or elsewhere. The Administration is not
responsible for any technical failures or other problems of telephone
networks or services, computer systems, servers or providers, computer
or telephone equipment, software, email service failures, or script
failures for technical reasons;
3.7 The Administration
is not responsible for any damage to a user's or third party's computer,
mobile devices, other equipment, or software caused by or connected with
downloading materials from the Site or via links posted on the
Site.
4. Privacy and data protection
4.1 User personal data is processed in accordance with applicable data
protection laws.
4.2 All data is entered at the user's discretion and may be made publicly
available, subject to clause 1.2.6 of the Rules. The registration email
address is never made public.
4.3 The Administration uses users' personal data for the following
purposes:
• registration;
• maintaining statistics;
• generating printouts from the site (e.g. match reports, tournament
entries, rosters, player profiles);
• delivering personalised advertising to users;
• conducting surveys/polls;
• email communications (e.g. site updates, invitations to matches,
training sessions, clubs, tournaments, player/team/training searches,
private messages, marketing campaigns, etc.);
4.4 The Site may use cookie technology. Cookies do not
contain confidential information. The user hereby consents to the
collection, analysis, and use of cookies, including by third parties,
for the purposes of compiling statistics and optimising advertising.
4.5 The Site receives information about the visitor's
IP address. This information is not used to identify the visitor.
4.6 The Administration undertakes not to disclose information
received from users. Disclosure shall not be considered a breach of
obligations where required by applicable law.
5. General provisions
5.1 These Rules
constitute the agreement between you and the Administration regarding
use of the Site and its services and supersede all prior agreements
between you and the Administration;
5.2 This Agreement is governed
by and construed in accordance with applicable local law. Matters not
covered by this Agreement shall be resolved in accordance with applicable
local law;
5.3 Jerks are not welcome;
5.4 The Administration does not post information about tragic
events, fundraising (except for the Site's own needs), or political
appeals on the Site;
5.5 If for any reason one or
more provisions of these Rules are found to be invalid or
unenforceable, this shall not affect the validity or applicability of
the remaining provisions.
